1. Acceptance of these terms
By using Orbit you confirm that you have read, understood, and agree to be bound by these Terms and by any policies referenced in them, including our Privacy Policy and any product- or extension-specific terms that apply to a domain you register.
Registering a domain also makes you subject to the requirements of ICANN (the body that coordinates the domain name system) and of the registry that operates the relevant extension. Where those requirements conflict with these Terms for a given domain, the registry and ICANN rules control for that domain.
2. Eligibility & your account
You must be at least 18 years old, or the age of majority where you live, and able to enter a binding contract to use Orbit. If you use Orbit on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
You are responsible for the information you provide, for keeping your account credentials confidential, and for all activity that occurs under your account. Tell us promptly if you suspect any unauthorized use. We are not liable for losses arising from your failure to safeguard your account.
3. The Orbit services
Orbit lets you search for, register, transfer, renew, and manage domain names, along with related features such as DNS management, WHOIS privacy, email and domain forwarding, and SSL provisioning where offered.
Orbit is a reseller. Registrations are fulfilled through our ICANN-accredited registrar partner and the applicable registries. We may add, change, or discontinue features, and not every extension or feature is available in every country.
4. Domain registrations, transfers & renewals
Searching for a domain does not reserve it. A registration, transfer, or renewal is only complete once payment is confirmed and the registry accepts the order; until then, availability and price may change, and an order may be declined.
You agree to the following in connection with any domain:
- Provide accurate, current, and complete registrant contact details, and keep them up to date — inaccurate or unverified details may lead to suspension or cancellation under ICANN rules.
- Comply with the policies of ICANN and the relevant registry, including dispute, transfer, and eligibility rules for certain extensions.
- Understand that transfers in or out may be subject to lock periods, authorization codes, and registry timelines outside our control.
- Renew on time — if a domain expires it may enter redemption or be released, and recovery (where possible) may incur registry fees.
- Accept that we cannot guarantee that a requested domain is available, free of third-party rights, or that any registration will be uninterrupted.
5. Fees, billing & taxes
Prices are shown before you complete an order and are charged through our third-party payment processor; we never store your full card number. The amount you see at checkout is the amount you pay, inclusive of applicable taxes and fees where we are able to calculate them.
You are responsible for any taxes, duties, or charges imposed by your jurisdiction that are not collected by us. Prices may be displayed in your selected currency using current exchange rates; the charged amount may vary slightly from estimates due to rounding and your bank’s conversion.
6. Automatic renewal
To help prevent accidental loss of a domain, eligible registrations are set to renew automatically. Before each renewal we will attempt to charge your payment method at the then-current renewal price, which may differ from the initial promotional price.
You can turn off automatic renewal at any time from your dashboard. If you disable auto-renewal, your domain will expire at the end of its term unless you renew it manually.
7. Refunds & cancellations
Domain registrations, transfers, and renewals are generally non-refundable once submitted to the registry, because registry fees are incurred immediately and are not returned to us. Where a refund is required by law or by an applicable registry policy, we will honor it.
If a charge was clearly made in error, contact us and we will investigate. Cancelling a domain or disabling auto-renewal stops future charges but does not entitle you to a refund of fees already paid for the current term.
8. Acceptable use
You agree not to use Orbit or any domain registered through us to:
- Break the law, infringe intellectual property, or violate the rights of others.
- Send spam, run phishing or malware campaigns, or engage in fraud or deceptive practices.
- Distribute content that is unlawful, abusive, or harmful, or that exploits or endangers minors.
- Interfere with, probe, or attempt to gain unauthorized access to the service, our systems, or other users.
- Register domains in bad faith, including abusive bulk registration or cybersquatting.
9. Your content & responsibilities
You are solely responsible for the domains you register, the content and services you connect to them, and your compliance with all applicable laws — including providing your own visitors with any legally required privacy and cookie notices.
You represent that you have the rights necessary to register and use each domain and that doing so does not infringe or violate the rights of any third party. You will indemnify us as described below for claims arising from your domains or content.
10. Our intellectual property
Orbit, the orbitdomains.net site, our branding, and the software and design behind the service are owned by Orbit or our licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the service as permitted by these Terms; you may not copy, modify, resell, or create derivative works from it.
If you send us suggestions or feedback, you grant us a perpetual, royalty-free license to use them to improve the service, without any obligation to you.
11. Third-party services
The service relies on and may link to third parties — including our registrar partner, domain registries, payment processor, and other vendors. We do not control these third parties and are not responsible for their services, terms, or availability. Your use of a third-party service may be governed by that party’s own terms and policies.
12. Suspension & termination
You may stop using Orbit at any time. We may suspend or terminate your access, or cancel a domain, if you breach these Terms, fail to pay, create risk or legal exposure, or are required to do so by ICANN, a registry, or law. Where practical, we will give notice, but we may act immediately when necessary to protect the service or others.
On termination, your right to use the service ends. Sections that by their nature should survive — including those on fees owed, intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution — will continue to apply.
13. Disclaimers & warranties
The service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, secure, error-free, or that any domain will be available or registrable.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you; in that case those exclusions apply only to the extent permitted by law.
14. Limitation of liability
To the fullest extent permitted by law, Orbit and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill, arising from or related to your use of the service.
To the fullest extent permitted by law, Orbit’s total liability for any claim relating to the service will not exceed the greater of the amount you paid to Orbit for the relevant domain in the twelve months before the claim, or fifty US dollars (USD 50).
15. Indemnification
You agree to defend, indemnify, and hold harmless Orbit and its officers, employees, partners, and suppliers from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your domains or content, your use of the service, your violation of these Terms or applicable law, or your infringement of any third-party right. This does not apply to the extent a loss is caused directly by our own breach of these Terms.
16. Dispute resolution
Before bringing any formal claim, you agree to first contact us and try to resolve the dispute informally; we will do the same. Most concerns can be settled quickly this way. Please allow at least 60 days from the date you notify us for the parties to reach a resolution.
If we cannot resolve a dispute informally, it will be handled in accordance with the governing law and venue set out below. To the extent permitted by law, you and Orbit agree that disputes will be brought on an individual basis and not as part of a class or representative action. Disputes about domain ownership or registration may also be subject to ICANN dispute-resolution procedures such as the UDRP.
17. Governing law & venue
These Terms are governed by the laws applicable at Orbit’s principal place of business, without regard to its conflict-of-laws rules, and the courts of that jurisdiction will have venue over any dispute not otherwise resolved, except where mandatory consumer-protection laws of your country of residence provide otherwise.
18. Changes to these terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above, and for material changes that reduce your rights we will provide more prominent notice where reasonably possible. Your continued use of Orbit after an update takes effect means you accept the revised Terms.
19. Privacy
Our Privacy Policy explains how we collect, use, and share personal information, including the registrant details that must be provided to our registrar partner and the registries. By using Orbit you acknowledge that policy, which forms part of these Terms.
20. General provisions
These Terms, together with the Privacy Policy and any product-specific terms, are the entire agreement between you and Orbit regarding the service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
